Operator Terms

The BukNau platform (buknau.com and related services, “BukNau”, “we”, “us”) is operated by BukNau Holdings Limited, a company registered in Hong Kong. These terms are an agreement between BukNau Holdings Limited and the business on whose behalf an operator account is created (“you”, the “operator”). The person accepting these terms confirms they are authorised to bind that business.

BukNau promotes your listings to travellers and facilitates booking requests, messaging, quotes, invoices, and payment instructions. You are an independent business — not our employee, agent, partner, franchisee, or supplier of services to us. Every booking made through the platform is a contract directly between you and the traveller. You are the merchant of record for every sale: you set your prices, you receive the money, and you deliver the service.

To list on BukNau you must be a genuine, lawfully operating business in Papua New Guinea or Solomon Islands. Before your listings can take bookings we require your business details, bank account details, and taxpayer identification number (IRC TIN or Solomon Islands equivalent), and we may ask for licences or permits relevant to your services. You warrant that everything you provide is accurate and kept up to date.

You are solely responsible for holding — and keeping current — every licence, permit, registration, and approval your services require under the laws of Papua New Guinea or Solomon Islands, including tourism licensing, transport licensing, and maritime certification where applicable.

Listings must describe your services accurately: real photos you have the right to use, honest descriptions, correct prices, and availability kept current. A traveller who books at a listed price is entitled to that price. Misleading listings, bait pricing, or listing services you cannot deliver are grounds for removal and account suspension.

Honour every booking you confirm. Respond to requests and messages promptly, record traveller payments as soon as you receive them so bookings confirm, assign the actual vehicle, room, or boat before the service, and deliver what was booked. If you must cancel, do it as early as possible through the platform so the traveller is notified and refunded per your policy.

Travellers pay you directly by bank transfer to the account you registered. BukNau does not receive, hold, or remit traveller money. You are solely responsible for your taxes — including GST and income tax in Papua New Guinea or Solomon Islands — and for issuing any receipts or tax invoices the law requires. Any fees payable to BukNau for platform services will be set out in a separate fee schedule agreed with you before they apply.

You set your own cancellation policy, and it must be published on your page and applied consistently. Refunds you owe under your policy or under law are yours to pay, promptly and to the traveller’s account. BukNau may record refunds against bookings for both sides’ records, but the payment itself is between you and the traveller.

You are responsible for the safety of your services — vehicles roadworthy, vessels seaworthy and properly equipped, guides competent, premises safe. You must hold insurance appropriate to your services (such as public liability, passenger, or marine cover) where available and required, and you confirm that nothing about your operation puts travellers at undisclosed risk.

The platform is provided “as is”. To the fullest extent permitted by law, BukNau Holdings Limited is not liable for lost profits, lost bookings, or any indirect loss arising from your use of the platform, and our total liability to you is limited to the fees you have paid to BukNau Holdings Limited in the 12 months before the claim, or PGK 250 if greater.

You will indemnify BukNau Holdings Limited against claims, losses, and costs (including legal costs) arising from your services, your listings, your breach of these terms, or your breach of law — including claims by travellers relating to a service you provided or failed to provide.

Traveller details shared with you (contact details, identity documents, booking information) may be used only to deliver the booked service and meet legal obligations — never sold, shared, or used for unsolicited marketing. Keep them secure and delete them when no longer needed.

You can stop listing at any time; confirmed bookings must still be honoured or lawfully cancelled and refunded. We may suspend or remove listings or accounts for breach of these terms, fraudulent or unsafe conduct, repeated traveller complaints, or legal risk. Where practical we will tell you why and give you a chance to respond.

We may update these terms as the platform evolves. The date above shows the current version; material changes will be notified to your account email. Continuing to use the platform after a change takes effect means you accept the updated terms.

These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have non-exclusive jurisdiction. Your obligations to travellers and regulators under the laws of Papua New Guinea or Solomon Islands are unaffected.
